Umart x Microsoft PC Giveaway March 2025 - Terms and Conditions
Introduction
For the purposes of these Terms and Conditions, "The Promoter" refers to New Eagle International Pty Ltd T/A Umart Online. The "Prize" refers to one (1) G5 Intel Ultra 5 245KF GeForce RTX 4060 Gaming PC - Powered by ASUS 58368. One (1) winner will be selected by the Promoter at random from those eligible entries received during the promotion period.
Participating in the competition means agreeing to these competition terms and conditions. The competition is being run by "The Promoter".
Eligibility to Enter
The competition is open to entrants who are over 18 years of age and residents of Australia. Employees, contractors, and their immediate families are excluded from the draw.
By entering the competition, you confirm that you are eligible to do so and that you are eligible to receive any prizes that may be awarded to you.
There is a limit of one entry per person, and the competition is open to anyone who meets the eligibility during the promotion period by purchasing selected Microsoft Windows 11 Pro including ESD, DVD, and USB during the promotion period. Orders that are cancelled will be disqualified from entry.
The promotion period begins on 20 March 2025. All purchases must be completed by 11:59 PM AEDT 1 April 2025.
The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any lost, delayed, illegible, corrupted, damaged, incomplete, or otherwise invalid entries.
The Prize
The winning prize is one (1) G5 Intel Ultra 5 245KF GeForce RTX 4060 Gaming PC - Powered by ASUS 58368. The prize is non-transferable and non-exchangeable, and no cash alternatives will be provided.
We reserve the right to substitute prizes of equal or greater value if circumstances beyond our control require doing so.
The Promoter's decision is final. No correspondence will be entered into.
Winner Announcement
The winner will be chosen randomly and notified via the email address provided on 7 April 2025.
The Promoter will make two attempts to contact the winner via email. If the winner does not respond within 5 (five) days of the second email, they forfeit their right to the prize, and the Promoter reserves the right to select and notify a new winner.
The winner’s name and social media username may be posted on the social media profiles of The Promoter after the winner has been selected.
Delivery of the Prize
The winner will allow 14 days for the prize to be delivered. Alternative collection or delivery arrangements can be made through mutual agreement. You may be responsible for covering any reasonable delivery costs to your location.
Data Protection and Publicity
You agree that any personal information provided when entering the competition will be used by the Promoter for administering the competition and other purposes specified in our Privacy Policy.
All entrants may request information on the winning participant by emailing feedback@umart.com.au.
If requested by the Promoter, the winner agrees to release their first name and place of employment to other competition participants. The winner's first name will be announced on the Promoter’s website and social media channels.
Limitation of Liability
To the extent permitted by applicable law, The Promoter's liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
The Promoter shall not be liable for any indirect, special, or consequential cost, expense, loss, or damage suffered by a participant, even if reasonably foreseeable, arising from breach of contract, tort, negligence, or otherwise.
General
The Promoter reserves the right to cancel the competition or amend these terms and conditions at any time and without prior notice.
In the event of unforeseen circumstances beyond The Promoter’s reasonable control, they reserve the right to cancel, terminate, modify, or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
